The High Court of Jammu & Kashmir and Ladakh has upheld compensation of more than ₹52 lakh for a professional driver who suffered an amputation following a road traffic accident, in a ruling that underlines the long-term financial consequences of limb loss.

For someone whose livelihood depends on driving, the effect of a major lower-limb injury can be particularly severe. Even when a prosthesis successfully restores walking, the individual may not automatically regain the physical ability, licensing eligibility or confidence required to return to their previous occupation.
Prosthetic provision is not a one-off expense
One of the most important issues in cases involving amputation is the assumption that the cost of an artificial limb can be addressed with a single payment.
That does not reflect the reality of prosthetic care.
A lower-limb amputee may require several sockets during the first years following amputation as residual-limb volume changes. Over a lifetime, the patient may also require:
- replacement prosthetic sockets;
- replacement feet, knees or other components;
- liners and suspension systems;
- repairs and servicing;
- gait training and physiotherapy;
- clinical reviews and alignment adjustments;
- treatment for skin or residual-limb complications.
A prosthetic limb is therefore not comparable with a permanent implant that is fitted once and forgotten.
For younger amputees in particular, the cumulative lifetime cost of maintaining mobility can be substantial.
Loss of earning capacity can exceed physical disability percentage
The case also raises an important distinction between medical impairment and functional or vocational disability.
A driver may retain considerable independence following rehabilitation but still experience a near-total loss of capacity to perform the occupation that previously provided their income.
Indian courts have repeatedly had to consider this issue in motor accident compensation cases.
The Supreme Court has previously emphasised that assessment of compensation should consider how an injury affects the claimant’s actual earning capacity rather than mechanically applying a medical disability percentage.
That principle is especially relevant in prosthetics.
Two people with the same amputation level may experience dramatically different vocational consequences depending on their occupation. A transtibial amputee working at a desk may ultimately return to almost all previous duties, while someone whose job requires prolonged driving, climbing, heavy manual work or difficult terrain may face significantly greater occupational limitations.
For CPOs providing reports for legal or insurance purposes, documenting functional requirements and realistic occupational limitations can therefore be particularly important.
The lifetime cost of an artificial limb
Prosthetists also have an important role in helping courts, insurers and legal professionals understand future prosthetic costs.
The appropriate calculation should not necessarily be based on the price of the patient’s first prosthesis.
A person who becomes an amputee at 30 or 40 years of age may live with limb loss for another four or five decades.
During that time, components will wear out, technology may change and sockets will require replacement.
For example, even a relatively conservative five-year replacement cycle could mean a young amputee requiring eight or more major prosthetic replacements during their lifetime, excluding additional socket changes and repairs.
Higher-activity patients may require replacement more frequently.
This is why medical-legal prosthetic reports should ideally provide realistic projections of:
current prosthetic cost + expected replacement frequency + consumables + future clinical care.
Without that information, the long-term economic impact of amputation can easily be underestimated.
Prosthetic technology can help restore independence — but not erase the injury
Modern lower-limb prostheses can deliver excellent functional outcomes.
Advanced feet, improved suspension systems, lightweight materials, microprocessor technologies and better socket designs can allow many amputees to return to work, sport and highly active lifestyles.
But successful rehabilitation should not lead insurers or courts to assume that the underlying disability has disappeared.
The patient continues to live with limb loss.
Daily activities may require greater physical effort. Prosthetic users must manage their residual limb, maintain their equipment and plan for repairs or component failure. They may also experience periods when the prosthesis cannot be worn due to skin problems, socket-fit changes or medical complications.
There can also be secondary musculoskeletal consequences associated with altered gait and long-term compensation.
The objective of a prosthesis is therefore to reduce the functional consequences of amputation, not to make the original injury irrelevant.
Why the ruling matters to Indian CPOs
For Bharat CPO readers, cases such as this are important because prosthetists increasingly contribute to medico-legal assessments following road traffic accidents, workplace injuries and other traumatic amputations.
A strong prosthetic report can help establish:
- the patient’s level of amputation;
- expected functional ability;
- recommended prosthetic technology;
- anticipated replacement intervals;
- current and future socket requirements;
- lifetime component and consumable costs;
- rehabilitation needs;
- likely occupational implications.
CPOs should be cautious about providing unrealistic lifetime estimates based simply on multiplying today’s component price by a fixed number of years. Technology, patient needs and clinical circumstances will change.
However, failing to consider future replacement at all can significantly underestimate the financial consequences of limb loss.
Compensation must reflect life after amputation
The J&K High Court decision is ultimately about compensation rather than prosthetic technology.
But for the P&O profession, it reinforces a message clinicians understand well: the consequences of amputation do not end when the wound heals or when the first prosthesis is delivered.
A successful prosthetic intervention can dramatically improve mobility and independence, but the patient still faces a lifetime relationship with rehabilitation services and prosthetic technology.
Where amputation has also removed an individual’s ability to continue in their established profession, the financial impact can extend far beyond the cost of the device itself.
The ₹52 lakh award upheld by the High Court therefore provides another reminder that compensation following limb loss must consider the whole person — their mobility, employment, future healthcare and lifetime prosthetic needs — rather than treating an artificial limb as a one-time purchase.
